According to the Niagara Parks Act and its accompanying Regulations 829, the Niagara Parkway is classified as a “controlled access roadway,” under Section 38 of the Public Transportation and Highway Improvement Act.
As such, a permit from NPC is required for such things as direct access to the Niagara Parkway (driveways), for fences, buildings, fruit stands, plantings or any other structures within 45 metres of the NPC property line or 395 metres of a centre point of an intersection. Signs within 400 metres (1,312 feet) of NPC lands are also subject to the approval of NPC.
